This section provides an overview of the notification procedures and guidance standards for performing asbestos emission work stipulated in the Ordinance on conservation, etc. of Yokohama City Living Environment (hereinafter referred to as the “Ordinance”) in Yokohama City. In addition, it is also regulated as specific dust discharge work based on the Air Pollution Control Law. Please check here for specific construction subject to notification.

Outline of regulations related to demolition, remodeling and repair work of buildings and other structures
- Based on the Air Pollution Control Law, it is necessary to investigate in advance whether specific building materials are used in buildings to be dismantled, modified or repaired.
- Those that fall under the work stipulated in the ordinance are subject to the regulations.
- registration form must be submitted at least 7 days prior to the start of the work.
- Please comply with work standards based on the Air Pollution Control Law and guidance standards based on ordinances.
- Based on the regulations, it is mandatory to measure asbestos concentrations.
- You must submit a completed registration form within 30 days after completing the work.
- In the case of specific construction subject to notification stipulated by the Air Pollution Control Law, it is necessary to submit a notification procedure for work such as specific dust discharge based on the Air Pollution Control Law.
- When performing construction that is not subject to the notification of the Air Pollution Control Law or the ordinance, please refer to the pamphlet "In dismantling, remodeling or repairing buildings, etc." and take necessary measures.
The work of dismantling, remodeling, or repairing buildings that use the following asbestos-containing building materials is subject to the regulations of the regulations.
- Sprayed asbestos
- Insulation materials containing asbestos, heat insulating materials and fire-resistant coating materials (excluding sprayed asbestos) Hereinafter referred to as "asbestos-containing heat insulating materials, etc.")
- Asbestos cloth
- Cement building materials containing asbestos (limited to molded plates) The following is referred to as "asbestos-containing cement building materials." Limited to those with a total area of 1,000 square meters or more of asbestos-containing cement building materials in the buildings, etc. subject to the work. )
- Finishing coating materials containing asbestos and base adjustment coating materials (hereinafter referred to as "asbestos-containing finishing coating materials, etc.")
Specific examples of sprayed asbestos and asbestos-containing heat insulating materials that are subject to these work and interpretation of terms that are not defined in the regulations are in accordance with the Air Pollution Control Law.
The procedure differs depending on the type of work, and it is as follows.

(1) Preliminary surveys and their explanations
Based on Article 18-15 of the Air Pollution Control Law, the prime contractor or independent contractor of construction work (hereinafter referred to as "demolition work") involving the work of dismantling, remodeling or repairing buildings, etc. (Refer to a person who constructs himself without doing so) must investigate in advance whether or not specific building materials are used in the parts of the building, etc., and create and save records of the survey. In addition, at the construction site such as demolition, it is necessary to post the results of the preliminary survey so that it is easy for the local residents to see it, and to keep a copy of the record of the preliminary survey.
The prime contractor must explain the results of the preliminary survey to the ordering party in writing and keep a copy of the document.
Since the new use of asbestos has been banned since September 1, 2006, buildings, etc. that clearly indicate that construction work was started after September 1, 2006 in writing, etc. There is no need for a written survey or visual survey. (2) Report on the results of the preliminary survey
Based on Article 18-15 of the Air Pollution Control Law, the prime contractor or independent builder of the demolition work must submit the preliminary survey results using an electronic system (asbestos preliminary survey result report system (outside site)) for construction of a certain scale or more. Must be reported. A report is also required if there is no asbestos.

(3) Preliminary survey by qualified persons
When performing construction such as demolition of buildings after October 1, 2023, a preliminary survey by the following qualified persons was required. In order to obtain qualifications, it is necessary to attend and complete the courses conducted by the registered training institution. For details and the latest registered training institution information, please check the Asbestos General Information Portal Site (outside site).
- Investigators of building materials containing specified buildings asbestos (specified investigators)
- General building asbestos-containing building materials surveyor (general surveyor)
- Investigators for building materials containing single-family houses (investigators for single-family houses)
- Those who have been registered with the Japan Asbestos Survey and Diagnosis Association before September 30, 2023, and are still registered at the time of conducting the preliminary survey.
※Even if construction work such as demolition is started before October 1, 2023, it is necessary for qualified persons to perform a new preliminary survey after October 1, 2023.
In addition, when conducting an asbestos content analysis in a preliminary survey after October 1, 2023, it is necessary to request an analysis from a person who has taken an analysis survey course specified by the Minister of Health, Labor and Welfare based on the Asbestos Regulations and passed the completion examination (Notification No. 277 of the Ministry of Health, Labour and Welfare in 2020).

In accordance with Article 92 of the Ordinance, the submission of work by registration form is required. Please submit the form to the counter with attached documents as the cover. Also, please unify the size of the registration form documents to A4 and fold large drawings to A4. In addition, please contact the the Labor Standards Inspection Office and Resources and Waste Recycling Bureau Business Waste Management Division Administration Section, as it may be necessary to submit notifications based on the Occupational Safety and Health Regulations and the Asbestos Disorder Prevention Regulations, the Yokohama City Waste Reduction, Recycling and Proper Treatment of Waste Management and Public Cleansing Regulations.

About setting of bulletin board to disseminate work contents
The prime contractor or independent builder must provide a bulletin board with the following items in a position that is easily visible to nearby residents.
- The name or name of the ordering party and the prime contractor or independent contractor of asbestos discharge work, and the name of the representative in Address and corporations
- Date of notification and destination
- Name and contact information of the site manager of the prime contractor or independent contractor of the asbestos discharge work
- Period of asbestos discharge work
- Method of asbestos discharge work

If required items is listed, you don't have to be this template.
Based on the guidance standards, the size of the bulletin board must be A3 size or more, posted at least 3 days before the work start date, and posted until the work is completed.
Emergency measures, etc.
Based on the guidance standards, the prime contractor or voluntary contractor shall immediately notify the mayor when asbestos is scattered or there is a risk of scattering due to asbestos discharge work. At the same time, it is necessary to take emergency measures to prevent asbestos scattering. In addition, it is necessary to report the situation of the situation concerned and summary of measures taken to the mayor promptly.

Based on Article 93 of the Ordinance, the prime contractor or independent builder must measure the asbestos concentration in the atmosphere at the place where the work is performed, record the results, and save them. The measurement position, measurement frequency, etc. differ depending on the work method and work period. Also, if the total fiber concentration exceeds 1 fiber / L, check the asbestos fiber concentration with an electron microscope. Based on Article 93-2 of the Ordinance, when the work is completed, the prime contractor must report the results to the ordering party in writing, make a record of the work, and keep a copy of this record and the report document there is.
The independent builder also needs to create and save records of the work.

Since the work content of the construction is largely dependent on the order from the ordering party, the ordering party is required to give consideration to the construction method, construction period, cost, etc. so that the work can be performed appropriately. In addition, it is required that the prime contractor or subcontractor take care of all or part of the construction to another person.

Article 95 The ordering party of asbestos discharge work shall notify the main contractor of the asbestos discharge work with the asbestos discharge work regarding the construction method, construction period, construction cost, and other matters related to the contract for the asbestos discharge work. Care must be taken not to comply with the guidance standards of Article 90 and to provide conditions that may prevent the prime contractor from performing measurements pursuant to Article 93.
(2) The provisions of the preceding paragraph shall apply mutatis mutandis to the case where a prime contractor or subcontractor of asbestos discharge work contracts all or part of the asbestos discharge work to another person.
