Overview of Regulatory Measures
According to the "Law Concerning the Improvement of Energy Consumption Performance of Buildings (Building Energy Conservation Law)", when building buildings (new construction, extension, renovation) conform to building energy consumption performance standards (energy saving standards) It is mandatory to do.
This duty of conformity is a building standard-related rule, and you cannot receive a certificate of completion of the Building Standards Law unless you have received a conformity assessment of the energy saving standard.
Regarding the previous notification obligation
Due to the enforcement of the revised law on April 1, 2025, in principle, all houses and non-residential buildings started after the enforcement date are subject to energy-saving conformity obligations. Please note that the previous notification obligation has been abolished, and it is no longer necessary to submit a change notification, etc. pertaining to the notification obligation.
Subject to regulatory measures (Article 10 of the Act)
In the case of extension / remodeling, the part to be expanded / renovated is subject to compliance obligations and does not include the existing part.
Exemptions (Articles 10 and 20 of the Act)
The following buildings are not subject to regulatory measures and are not subject to compliance with energy conservation standards.
- Buildings with a floor area of 10 m2 or less (excluding those with high openness)
- Those that do not need to install air conditioning equipment because they do not have a living room
- High openness and no need to install air conditioning equipment
- Historic buildings, Cultural Properties, etc.
- Emergency temporary buildings, temporary buildings, temporary exhibition halls, etc.
Judgment of exemption is made on a building-by-building basis.
For details of buildings that are exempt from application, please refer to "Enforcement of Laws on Improvement of Energy Consumption Performance of Buildings (Technical Advice)" (external site) (March 15, 2017 Kunizumi Building Ring No. 215, Kunizumi finger No. 4190).
When the conformity assessment can be omitted (Article 11 of the Act)
In the following cases, the conformity judgment of the energy saving standards in the confirmation application can be omitted.
- Buildings listed in Article 6, Paragraph 1, Item 3 of the Building Standards Act (one-story and 200m2 or less) pertaining to the design of an architect
- When the energy-saving standard conformance is confirmed using the specification standard or guidance specification standard (described later) (*1) (*2)
- When a design house performance evaluation report is issued, a long-term excellent house is certified, and a long-term use structure is confirmed (* 1).
However, please note that it is subject to the obligation to comply with energy conservation standards.
(*1) In the examination of building confirmation, we confirm energy saving standard conformity.
(*2) Only when both outer skin performance and primary energy consumption are confirmed for the entire building according to specification standards.
Energy Conservation Standards (Ministry of Standards Ordinance Article 1)
The Ministerial Ordinance of the Building Energy Conservation Law stipulates energy-saving standards for non-residential and residential areas.
[Non-residential portion] Satisfy either (b) or (b)
- [A] The standard input method confirms that the design primary energy consumption does not exceed the standard primary energy consumption.
- [b] The model building method confirms that the primary energy consumption of design does not exceed the standard primary energy consumption.
[Housing portion] Satisfy both b and b
- [A] Outer skin performance: (1) or (2)
(1) In each dwelling unit, the average heat penetration rate for the outer skin is 0.87 or less, and the average solar heat acquisition rate during the cooling period is 2.8 or less.
(2) Meet the standards (specification standards and guidance specifications standards) specified by the Minister of Land, Infrastructure, Transport and Tourism. - [b] Primary energy consumption: (1) or (2)
(1) Design primary energy consumption does not exceed the standard primary energy consumption.
(2) Meet the standards (specification standards and guidance specifications standards) specified by the Minister of Land, Infrastructure, Transport and Tourism.
[Combined buildings] Satisfy either (b) or (b)
- [A] Non-residential part and housing part are compatible with each other.
- [b] The residential part conforms to the outer skin performance, and the design of the complex building primary energy consumption does not exceed the standard primary energy consumption of the complex building.
