Building permit based on Article 53 of the City Planning Act

Purpose
When we build building in area of city planning facility where city planning was decided or enforcement area of city area development business to secure smooth enforcement of future business, it is necessary to receive permission of the mayor of Yokohama .
Acts subject to permission
Construction of buildings in the area of city planning facilities or in the enforcement area of urban development projects (* 1).
The construction of a workpiece is not an act subject to permission.

Permit criteria
The building meets all of the requirements listed below and can be easily relocated or retired.
- Notification such as business approval (Article 62, Paragraph 1 of the City Planning Act) has not been made (* 2) It must be performed in the area of city planning facilities.
- The number of floors is 3 or less, the height is 12m or less, and there is no basement.
- The main structural part (the main structural part specified in Article 2, Item 5 of the Building Standards Act) must be wooden, steel, concrete block, or other similar structures.
In addition, as there is relaxation about construction such as general road or digging garage, please confirm summary and operation standard for the details.

※2: If a notification of business approval or approval (Article 62, Paragraph 1 of the City Planning Act) is made, the permission provisions of Article 53 do not apply. Article 65 Please refer to the contents of permission.
How to submit documents
At the City Planning Division window, we accept documents submission. We also accept applications by mail.

Permit procedure period
It will take about 7 business days after receiving the documents.
In the case of areas such as city planning roads under business other than the City Planning Act (* 3), it takes about 2-3 weeks to refer to the company.
※3: As a general rule, we cannot build a building in the business area, but we may give permission when we can confirm that there is no obstacle to the enforcement of the business. For example, building activities at the top of a tunnel (underground) structure are applicable. When we build building in business place, I would like discussion with business bureau beforehand.

Except for the letter pack, two or three copies (* 4) are required for permission applications and various attached documents.
- Permit application (seal is not required)
- Power of Attorney (when delegated). seal is not required. ※5
- Guide map (with a scale of 1/2500 or more that describes the direction, site location, public facilities around the site, etc.)
- Layout map (with a scale of 1/500 or more that describes the location, direction, site boundary, relationship between site and road)
- Floor plan (with a scale of 1/200 or more)
- Elevations (with a scale of 1/200 or more. Two or more elevations are required.
- Cross-section (with a scale of 1/200 or more). Two or more cross-sections are required.
- Browse diagram of each floor (unnecessary for wooden structures) ※6
- Aximum diagram (not required for wooden structures) ※6
- Basic drawing (unnecessary for wooden structures) ※6
- Manufacturer's certificate (unnecessary for wooden construction) ※6

※4: In the case of permission in the area of undeveloped city planning roads and urban development projects, the required number of copies is two. In the case of city planning roads under business, city planning parks, etc., three copies are required.
※5: There is no designation in the form, but please state in the delegation item "All thing about permission application and change of Article 53 of the City Planning Act".
※6: If you attach a “Mufacturer Certificate for Model Members, etc.”, you do not need a “Floodwork Map”, “Floodwork Map”, and “Flood Map”.
※7: Reply letter packs can be accepted in either red (plus) or blue (light). Please fill in the "Postal Code" and "Delivery Address" fields and submit it.

Article 53 Exceptions to Permission (Deemed Rules)
Buildings corresponding to any of the following are considered to have Article 53 permission (Handling Guidelines Article 4 on Building Permits in the area of city planning facilities) (PDF: 369KB), Article 53 permission application procedure Is not required (excluding housing facilities in one complex).
1.In building built in area of city planning facility which maintenance was completed by city planning business, the mayor discusses with company such as the city planning business or manager (* 8) of the city planning facility concerned, Those who admit that there is no problem in the maintenance and management of the city planning facility
2.Gates or fences that have wooden, steel, concrete block, or similar structures.
3.Building equipment
