When a request for examination is made, a "trial member" will be appointed as the person who presides over the hearing procedure. In order to enhance the fairness neutrality of the hearing procedure, the hearing officer will be appointed as the hearing officer who is not involved in the decision on the disposition pertaining to the request for examination (in Motoichi, a lawyer is appointed and appointed as the hearing officer. ) 。
During the hearing procedure, if you submit a counterar or evidence, you must submit it to the hearing officer.
The examiner receives a statement of defense from the Disposal Agency and a counter-argument from the requester for examination, conducts necessary investigations, etc., and prepares a written opinion on the decision to be made by the Examining Agency (investigator's opinion). And submit it to the Examining Agency along with the case record.
