Supervision Information
(1) Response to corporations that have not submitted business reports
The main feature of the NPO Law is that it respects free corporate management and is a system in which the involvement of the competent authority is minimized, assuming the selection and monitoring of citizens through information disclosure.
The competent authority may exercise the minimum necessary supervisory authority only if there is a reasonable reason that is suspected of violating laws and the Articles of Incorporation.
NPO corporations are required to prepare business reports, etc. within the first three months of each fiscal year and submit them to the competent authority from the viewpoint of fulfilling accountability to citizens and enhancing public interest. .
Contrary to the provisions, the NPO Law stipulates that corporations that have not submitted business reports, etc. for three years can revoke their certification, and Motoichi aims to ensure smooth execution of affairs based on the law. Based on the Administrative Procedure Law and the "Handling Guidelines for Non-Profit Organizations Submitted Business Reports", we will respond to corporations.
(2) Procedures for responding to corporations that have not submitted business reports
1.Sending a reminder letter
Send a reminder document to the representative of the corporation.
2.Sending a dunning letter (first time)
A reminder document with a deadline for submission will be sent to the representative of the corporation.
3.Sending a dunning letter (second time)
A reminder document with a deadline for submission will be sent to all corporate officers.
For corporations that have not submitted a business report for more than three years, the procedure after 4 will be entered.
4. Publication of corporations that have not been submitted for more than 3 years (homepage)
We will publish corporations that have not submitted business reports for more than three years on our website.
5.Notification of fines case, order for improvement
We will send a notice of fines to the district court in charge of the Chairman's Address and issue an order to improve the business report.
6.Notification of hearing held
The notice of the hearing will be sent to the president of the corporation.
7.Holding a hearing, canceling certification
After the hearing is held, the certification will be canceled and the results will be announced on the website.

(4) Status of cancellation of certification of corporations that have not submitted business reports

(5) If the certification is revoked because the business report is not submitted.
You cannot become an NPO officer until two years have passed since the date the establishment certification was revoked.
If you are also a director of another NPO, please be careful.
(6) Response of unregistered organizations after certification
An NPO corporation will be established by registering the establishment at the location of the main office after being certified by the competent authority.
However, contrary to the provisions, the NPO Law stipulates that organizations that do not register for establishment for more than six months can revoke their certification, and Motoichi plans smooth execution of administrative work based on the law Therefore, we will respond to corporations based on the Administrative Procedure Law and the "Handling Guidelines for Unregistered Organizations after Certification".

A reminder document with a deadline for submission will be sent to the applicant for certification of establishment of the corporation.
※As a result of checking the status of registration, corporations that have been confirmed to have not been registered will be subject to procedures 4 or later.
4.Notification of hearing held
The notice of the hearing will be sent to the applicant for certification of the establishment of the corporation.
5.Holding a hearing, canceling certification
After the hearing is held, the certification will be canceled and the results will be announced on the website.
