The Housing Lodging Business Law was enforced on June 15, 2018, and by submitting a notification to the mayor of Yokohama, a business (Housing Lodging Business / Minpaku) that allows people to stay in a house within a range not exceeding 180 days a year It can be done in the city. 1.Confirmation and implementation before notification of the housing accommodation business
Please be sure to check the following materials before submitting the notification.
For those who are going to do the housing accommodation business (minpaku) (PDF: 1,797KB)
(1)Confirmation of the target "house"
"Housing" that can carry out the housing accommodation business must meet the equipment requirements and living requirements.
In addition, those used for other businesses (lending as rental spaces, using as business establishments, etc.) are used for other businesses.
It is excluded from the scope of housing.
Equipment requirements
The following four facilities must be provided in the house to be notified (hereinafter referred to as "reported house").
- Kitchen
- Bathroom
- Toilet
- Bathroom facilities
Residency requirements
Report house must be house corresponding to any of the following.
- Houses that are actually used as the home of people's lives
- Houses where residents are being recruited
- Houses that are used for the residence of the owner, lessee or lessee at any time.
(2)Confirmation of the number of days for people to stay in a house
If you submit a notification of the housing accommodation business, you can let people stay in the house within a period not exceeding 180 days a year. However, depending on the area, the ordinance limits the period of project implementation, so be sure to check the contents of "1 (5) Confirmation of restrictions based on the ordinance" on this page.
In addition, the total number of stays in the housing accommodation business is calculated for each registered house, and even if there is a change in the business operator, the number of stays will be taken over and counted. When conducting a business, please confirm the accommodation performance at the house prior to notification.
(3)Confirmation of fire laws and regulations
When implementing the housing accommodation business, it is necessary to comply with the Fire Service Law, so please consult in advance. Depending on the form of the reported house, it may be treated as an inn or hotel according to the Fire Service Law, so it may be necessary to install new fire equipment such as automatic fire alarm equipment.
When submitting a notification of housing accommodation business to Medical Care Bureau Health Sanitation Division, please submit a copy of the “Firefighting Law Compliance Notice” or “Confirmation Form for Notification of Housing Accommodation Business”.

(5)Confirmation of restrictions based on ordinances
In Yokohama City, the ordinance stipulates restrictions on the area and period for implementing the housing accommodation business.

- In the "first-class low-rise residential area" and "second-class low-rise residential area", the housing accommodation business cannot be performed from noon on Monday to noon on Friday (excluding holidays, etc.).
- When you confirm restricted zone, please use Yokohama-shi administrative map reporting system "i-mappie" (outside site).
※Restricted areas are subject to change due to a review of the entire city. Make sure you check it regularly. - If the majority of the site of the house is included in the low-rise residential area, the area is regarded as a low-rise residential area.

(6)Confirmation of condominium management rules, etc.
Condominiums can provide housing accommodation services if Residential Association does not prohibit housing accommodation services. Make sure that the business is not prohibited and submit the following documents at the time of notification.
- If the building with a house is a building with two or more sectional owners and has a private part to be used for human residence, a copy of the agreement on the use of the exclusive part
- In the case of 1, if there is no provision in the terms and conditions regarding the operation of the housing accommodation business, one of the following documents certifying that Residential Association has confirmed that there is no intention to prohibit the operation of the housing accommodation business in the notified housing.
- A written oath (Form C (PDF: 55KB)) confirming that the policy of prohibiting the housing accommodation business has not been resolved at the General Assembly or board member at theResidential Association in advance.
- The minutes of the General Assembly and the minutes of the board member since the enactment of the Housing Accommodation Business Act (June 9, 2017) and other documents certifying that there is no intention to prohibit the operation of the housing accommodation business in the Residential Association
If the terms and conditions stipulate the prohibition of the housing accommodation business, or if the Residential Association does not attach a document certifying that it has confirmed that it does not intend to prohibit the housing accommodation business, the notification of the housing accommodation business will not be accepted. In addition, if you submit the above documents, Yokohama City may contact Residential Association or the management company to confirm that Residential Association has no intention to prohibit the housing accommodation business. Please coordinate with Residential Association in advance.

Points to note when permitting or prohibiting a residential accommodation business in an apartment
In order to prevent troubles and complaints about the housing accommodation business, consider whether the housing accommodation business is possible or prohibited, and make sure that it is stipulated in the apartment management agreement. In addition, if the condominium management agreement is not revised in time by the scheduled date of notification of the person who starts the housing accommodation business, the General Assembly of Residential Association and the board member decide whether or not to implement the housing accommodation business, and inform the residents of that fact.

(8)Confirmation of city planning, building agreements, etc.
Buildings and land that start the housing accommodation business have restrictions on land use (use of buildings, etc.) of building agreements, district planning, local town development rules, city planning consultation districts (hereinafter referred to as "building agreements, etc.") May be. (9)Consignment to a housing accommodation management company

(11)Confirmation of food and drink provision
If you provide food and drink to guests at a registered house, you may need to submit a business license or notification based on the Food Sanitation Law. If you do business without permission, you may be subject to unlicensed business and you may be subject to punishment, so be sure to confirm in advance that it is a restricted zone where you can operate and consult with Health and Welfare Center Health Sanitation Division in the ward where the registered housing is located.

2.Notification
When we carry out house accommodation business in Yokohama-shi, we must report to the mayor of Yokohama beforehand every report house.

Q6 Is there a penalty for staying more than 180 days?
If the number of stays exceeds 180 days, it will be a violation of Article 3 of the Ryokan Business Act, and you may be punished with imprisonment for up to six months, a fine of up to one million yen, or both.
