1. About general meeting schedule of Yokohama-shi central agriculture committee
A
  • The Yokohama City Central Agricultural Committee has a general meeting where permissions and approvals related to the Agricultural Land Law, communication of agricultural policies and proposals are held.
  • The General Assembly is basically held on the 26th of each month. If the 26th is a holiday, it will be held on the day before the holiday (if the 26th is Sunday, it will be held on Friday 24th).
  • Items to be discussed at the General Assembly are limited to those submitted by the 10th of this month. In the case of a holiday, the day before the holiday is the deadline for submission.
  • Please contact the secretariat for specific dates and deadlines.
  • The main items to be discussed at the General Meeting are as follows.
    • Article 3 Permit of the Agricultural Land Law
    • Agricultural Land Law Article 4 and Article 5 permission (Urbanization adjustment area)
    • Request for Farmland Development Guidance
    • Issuance of Certificate of Eligibility for Inheritance Tax (Gift Tax) Tax Deferral
    • Other Certifications

2. Transfer of farmland rights (want to buy or rent farmland as farmland) ⇒ Permission under Article 3 of the Farmland Law
A
  • There are two ways to buy, sell, and rent farmland: based on Article 3 of the Agricultural Land Law and setting the right to use (* 1) based on the plan set by Yokohama City.
  • Article 3 of the Agricultural Land Law clarifies cases where it is not permitted. For example, if the transferee (buyer) does not cultivate all the farmland to be cultivated well (all requirements for efficient use), grouping of farmland, efficiency of agricultural work, and agricultural land in other surrounding areas (requirements for harmony with the community). First of all, please clarify who will acquire and where the specific lot number is, and then contact the Central Agricultural Committee Secretariat.

  • It may take more than one month from prior consultation to reception, so please consult early.

  • Lending and borrowing by the right to use is to promote the accumulation of farmland in certified farmers and local leaders, and to make effective use of farmland and stabilize agricultural management. Specifically, please consult with the Northern Agricultural Administration Office (Agricultural Administration Promotion Section).
  • When entering agriculture newly under the jurisdiction of the Central Agricultural Committee, both corporations and individuals need to consult with the Northern Agricultural Administration Office.

3. Diversion of farmland (I want to change farmland to uses other than farmland) ⇒ Agricultural Land Law Article 4.5 Permission [Urbanization adjustment area]

  • Diversion of farmland means making farmland something other than farmland, for example, changing it to a parking lot, material storage, house, road, etc.
  • The procedure varies greatly depending on the location (area) of the farmland you want to convert.
  • About farmland of urbanization adjustment area, please refer to central agriculture committee secretariat after clarifying concrete lot number, who converts concrete use.

You can check the urbanization area and the urbanization adjustment area from [Town Development Map Information "i-Mappy"] (outside site) (If you select [Restrictions by City Planning] from the large item [Restrictions by City Planning], the area will be shown ).

4. Deferral of inheritance tax and gift tax on farmland ⇒ Issuance of qualified person certificate, etc.

<Certificate to be submitted to the tax office when receiving the special application of inheritance tax or gift tax deferral>
※Please consult with the relevant tax office (external site) of the NTA in advance.

  • If you need proof of eligibility, please contact the Central Agricultural Committee Secretariat after clarifying the deadline for filing with the tax office, who will inherit, and the farmland that requires special application.
  • If you come to the agency, please make a reservation in advance by telephone etc. (Phone: 045-948-2475)
  • It may take more than one month from prior consultation to reception, so please consult early.
  • The deadline for submitting an inheritance tax return to the tax office is within 10 months from the day following the date of inheritance. Please be careful.

Certificate of all matters of farmland that requires special application (certified copy of land registry), official map, guide map, land and house comprehensive name registration matter certificate are required.
(2)On-site surveys
Investigate the current status of farmland that requires special application, and check the cultivation status and whether there are any places that cannot be applied.
(3)List of documents PDFto be submitted (PDF: 340KB)
The deadline is on the 10th of every month. Please submit the application form and the attached documents.
(If the 10th is a holiday, the deadline is the day before the holiday.)
(4)Deliberation
The General Assembly will decide whether or not to issue a certificate. The General Assembly is basically held on the 26th of each month.
(If the 26th is a holiday, it will be held on the day before the holiday.)
(5)Certificate issuance

5. Certificates required for continuous notification (those who have already received tax deferral) ⇒ Certificates that they are continuing farming

<Documents required for submitting the registration form tax deferral to the tax office>

  • A document that must be attached when submitting a “Gift Tax or Inheritance Tax Deferral registration form” to the tax office and is issued by the Agricultural Committee. This is a procedure that is required once every three years for some agricultural heirs who have already received the exception of tax deferral.
  • Applications for issuance of certificates are accepted from time to time. After the reception, a site survey will be conducted, and if there is no problem with the cultivation situation, it will be issued in about two weeks.
  • When applying, please make a reservation in advance by telephone, etc., and bring it to the counter (not mailable). (Phone: 045-948-2475)

6. I want to know the procedure for inheriting farmland ⇒ Article 3-3 notification of the Farmland Law
A

From December 2009, when farmland was acquired by inheritance, it was necessary to notify the Agricultural Committee.

  • When your inheritance registration is completed, please submit registration form required documents to the Agricultural Committee window after visiting the Agency (not mailable).
  • The current situation is limited to those of farmland.
  • There is no specific date from the date of inheritance to the notification.

7. I want to fill and cut the soil on the farmland ⇒ Guidance on construction of farmland / Temporary conversion permission
A
  • As a result of embankment without the guidance and permission of the government, there have been a series of cases where soil is piled up like a mountain, earth and sand flows out to surrounding farmland and roads, and soil containing gravel and construction waste can be put in. Therefore, rules are set for the creation of farmland.
  • The procedure differs depending on the scale (height and area to be created). Please contact the Central Agricultural Committee Secretariat as soon as possible, as it will take some time for construction to be started.

In some cases, the following certificates may be issued. If you have any questions about farmland, please contact the Central Agricultural Committee Secretariat.

  • Proof of cultivation
  • Current farmland certification
  • Proof of Farmers
  • Proof of the main worker of agriculture related to production green space
  • Permitted/accepted proof, etc.

9. We want to acquire production green tract of land ⇒ About mediation of production green tract of land which notified that Yokohama-shi does not buy
A
  • Based on Article 13 of the Production Green Space Law, about production green tract of land where Yokohama-shi decided not to buy, we perform mediation to farmer. If you have any questions about the acquisition of farmland or the location, please contact the Central Agricultural Committee Secretariat.
  • In order to obtain a production green area through this mediation, a procedure for permission under Article 3 of the Agricultural Land Law is required. In addition, after acquisition, it is mandatory to manage it as farmland.
